Ports Act 1998

Abstract
Part 1 of the Act deals with the Preliminary
and Part II with the Constitution and Functions of the Authority.
Under section is established the Authority which shall
be
the sole national port authority to regulate and control
the port sector and provide marine services. Section 4
deals elaborates the functions and duties of the Authority
and
section 5 creates a port masterplan to deal with the proper
implementation of the port..
Part III deals with the Financial provisions of the Act
including the principles of management, capital and borrowing
and investments.
Part IV deals with the General Powers and Duties, including
section 23, the general powers for the performance of any
of its functions. Section 24 deals with the granting of
a licence by the Authority inly authirised by the Authority.
Under section 30, the Authority shall have regard in discharging
its functions regard to the protection of the environment
and endeavour to achieve a reasonable balance between that
consideration and any other considerations to which it
is
required to have regard.
Part V deals with the Navigation and other Business in
Ports whislt Part VI deals with the Handling, storage,
and distribution
of Goods in Ports.
Part VII deals with the Liability of the Authority and
Licensed Operators and Part VIII with the Conservancy.
In this part,
the Authority has various powers including the power to
deal with idle vessels, to raise and remove wrecks, the
power
to investigate the discharge of pollutants, the pollution
of ports and to detain vessels amongst others.
