Abstract
Occupational
Safety and Health Act 2005
In force on 1st
September 2007
Part I deals with
the preliminary of this Act and Part II with the Duties and
Responsibility. Those duties include the duties of employers,
employees, self employed persons and Health and Safety
officers, among others.
Part III is concerned
with the Administration and the powers conferred upon the
Permanent Secretary and Part IV with the Health and Welfare
(General Provisions). Under this provision there are important
sections which need to be quoted such as section 35
(cleanliness), section 39 (sanitary conveniences), section 41
(washing facilities).
Part V deals with the
safety of machinery and that of dangerous machinery with
supervision and training of young persons working at such
dangerous machines.
Part VI also deals
with the General safety provisions such as that of substances,
explosives, fumes, lack of oxygen, the prevention of fire and
the safety provisions in case of fire. Similarly Part VII
includes effective measures to restrict exposure to radiations,
reduction of noise and vibrations and the notification of
occupational accidents and dangerous occurrences.
Part VIII deals with
the registration of factories and that of their building permit
whilst Part IX is mainly concerned with offences and penalties
including the legal proceedings that the court can make.
