Ground Water Act 1969

Abstract
Under this Act, all ground water shall vest in
the State (section 3). Section 4 deals with the licence
to abstract ground water and prohibition of pollution.
Any person who wishes to make an application for a licence
shall under section 5 make to on the prescribed form to the
Authority and cause a notice to be published in the Gazette.
There is provision for the rights and objection for the grant
of such a licence (section 6) ad section 7 deals with the
decision of the Authority to grant such a licence and also
the right to appeal against such a decision (section 8).
The Act empowers any authorized officer the power of entry
and inspects any ground water works amongst others (section
12),
Any person who according to section 15 of the Act fails
to comply with the condition attached to a ground water licence
shall commit an offence. The court may also upon inflicting
any penalty the forfeiture or the dismantling of any works
in the commission of the offence.
