(Industrial
Waste Audit) Regulations,
2008
Brief
1.
With
a view to promoting a clean and green environment and
mitigating the associated adverse health and environmental
impacts from industrial waste, the Ministry of Environment and
NDU has issued, under section 48 of the Environment Protection
Act, the Environment Protection (Industrial Waste Audit)
Regulations, 2008, as per GN
No. 255of 2008. These regulations shall come into
operation on 01
April 2009.
- Under
these regulations, any industrial activity listed in the
First Schedule will have to fill in an Industrial Waste
Audit (IWA) Form and submit it to the Director of
Environment within a period of 3 months. The IWA Form
requests for general information on the activity and
specific ones relating to the various environmental
aspects of the activity.
- Upon
receipt of the IWA Form, the Director may request the
person carrying out the activity to submit an IWA Report
within 6 months and to develop an Environmental Management
Plan (EMP) within a period of 9 months and implement the
EMP after it has been approved by the Director.
- The
EMP shall contain, inter-alia,
statement by top management on its environmental policy
and commitment, a description of the objectives and
targets, the structure put in place to implement it and a
description of how the organisation addresses all the
environmental issues such as air pollution, water
pollution, solid wastes (hazardous and non-hazardous),
noise as well as the record-keeping system put in place.
- Failure
to comply with the regulations shall constitute an offence
and the offender shall, on conviction, be liable to a fine
not exceeding 50,000 rupees.
