The
Schedule to the Environment Protection (Declaration of
Environmental Laws) Regulations 2005 provides for enactments
declared as environmental laws. This Schedule has now
been amended by the Environment Protection (Declaration of
Environmental Laws) (Amendment) Regulations 2009, as per
Government Notice No. 17 of 2009, which come into operation on
1st March 2009.
The
objective of the Environment Protection (Declaration of
Environmental Laws) (Amendment) Regulations 2009 is to cater
for amendments made following proclamation of the Environment
Protection (Amendment) Act 2008 and promulgation of the
Environment Protection (Control of Noise) Regulations 2008.
Further
to the proclamation of the Environment Protection (Amendment)
Act 2008, the Noise Prevention Act 1938 and all regulations
made under that Act were repealed and the Environment
Protection (Control of Noise) Regulations 2008 were
consequently promulgated to represent the single legislation
to control noise which constitutes a nuisance.
The
Waste Water (Standards for Discharge of industrial effluent
into a Waste Water System) Regulations 2004 have been included
in the list of declared environmental law.
